WHAT TO DO WHEN YOU HAVE BEEN IN AN AUTO ACCIDENT

Many people do not know what to do after an automobile collision. First, always call the police. An accident report should be completed even if the other party does not want one. Exchange insurance information with the other driver. You may need this information before you get the accident report, which will also list the insurance company for each driver.

My law office can help you with property damage, as well as getting your medical bills and lost wages paid. The first weeks after an automobile collision can be the most devastating to a family. Often, one will be off work with no income and no vehicle to drive.

If your car is damaged due to someone else's negligence, you are entitled to a rental vehicle. The insurance company for the person at fault is responsible for providing you with a rental car. Be careful; if you do not have full coverage on your own vehicle, you may have to pay insurance on the rental out of your own pocket. If the insurance company does not immediately provide you with a rental vehicle, you may also obtain money from the company to compensate you for the time you were without transportation. This is called "loss of use."

GETTING MEDICAL BILLS AND LOST WAGES PAID

In Kentucky, if you have been in an automobile accident, the insurance company that insures the car you were in is responsible for paying the first $10,000 in medical bills, lost wage, and prescriptions. If you must travel out of town to see a doctor, this insurance will normally pay your mileage, too. The company insuring the car you were in will pay your medical bills, lost wages and prescriptions, regardless of who was at fault in the accident. I can help you in obtaining these benefits, referred to as "PIP" or Personal Injury Protection benefits. There will be no additional fee to help you obtain these benefits.

While Kentucky law requires that each auto policy provides PIP benefits, you may have a $1,000 deductible. This is not standard, but you may have a deductible if you requested the least expensive policy available. If you have a deductible, that part of your medical bills, lost wages, etc., is your responsibility.
